RE:     Notice of Rental Rules Violation at Mountain Shadows

Dear NAME:

Please find enclosed the Condominium Rental Rules of the Boulder Townhouse Corporation.  These rules and regulations govern the rental of condominium units at Mountain Shadows and are designed to provide a more harmonious lifestyle between the owner occupants and tenants of Mountain Shadows as well as to protect our property values.   Also enclosed are the following forms referred to in the Rental Rules:

 

  1. Rental Application
  2. Agreement as to Rental of Condominium Units

Your unit has been identified as a rental property because all or part of the unit is either known or believed to be rented.  Based on that information, you are being sent this letter because it has been determined that the BTC file on your rental unit is missing information or the information is out of date (or there is no record on file of your unit being a rental).  Therefore, you are currently in violation of the enclosed Condominium Rental Rules of the Boulder Townhouse Corporation. 

City of Boulder Rental Requirements

In addition to compliance with the Condominium Rental Rules of the Boulder Townhouse Corporation, the Board of Directors requires that all rentals be in compliance with City of Boulder ordinances.  Obtaining a rental license is the responsibility of the property owner and involves having a City of Boulder licensed rental housing inspector perform an inspection of the property.  For complete information, procedures, applications and other forms on Boulder’s Rental Housing & Licensing Program, please visit the web:   (http://www.ci.boulder.co.us/buildingservices/inspection/rental/about.htm). 

A City of Boulder Rental License Application is enclosed.  Please obtain additional copies and address all questions regarding the City application process to Building Services at 1739 Broadway, Third Floor, or by calling the Rental Housing Inspection and Licensing program at (303) 441-3152.

You must have a current rental license on file with Boulder Townhouse Corporation in order to rent your unit.

BTC Penalty Schedule

The Board of Directors will levy the following penalties to owners who do not fully comply with the rules and regulations governing the rental of condominium units:

  1. A penalty of $100 will be assessed to any landlord who allows a tenant to move in before approval is granted.
  2. An additional penalty of $250 will be assessed to any landlord who does not submit the proper forms more than 10 days from the date of tenant occupancy.  The penalty will be assessed each month until the unit comes into compliance with the rental regulations.
  3. A lien may be placed on any property when an owner has not paid the penalties within ten days of being assessed, or rent payments may be garnished in order to satisfy the penalties.

Please note that in addition to being in violation of Mountain Shadows regulations, an unlicensed rental property will result in legal action by the City with a fine of up to $2,000 per violation and/or up to 90 days in jail.

You have 30 days from the date of this notice to come into compliance with the Condominium Rental Rules of the Boulder Townhouse Corporation and provide two (2) copies of a City of Boulder Rental License or penalties may be assessed and the City of Boulder will be notified about your unlicensed rental property.
